Terms and Conditions
1. Introduction
These Terms apply to SimonLive: the SimonLive app for Windows, your SimonLive account and SimonLive subscriptions. By creating an account, buying a subscription or using SimonLive, you agree to them. If you do not agree, do not use SimonLive.
“SimonLive”, “we” and “us” mean the SimonLive service and its independent seller. SimonLive is an independent product. It is not affiliated with or endorsed by TikTok or Roblox.
2. The product
SimonLive is Windows software for TikTok LIVE streamers. It runs a race in SimonLive’s own Roblox experience: a viewer joins by typing a Roblox username in your LIVE chat, and SimonLive adds an NPC racer for that viewer.
You need a PC with Windows 10 or Windows 11, an internet connection, a TikTok account that can go LIVE, and Roblox. SimonLive connects to your own LIVE with your TikTok username. It never asks for your TikTok password.
3. Your account
- You sign in to SimonLive with Google. Keep your Google account secure. You are responsible for what happens in your SimonLive account.
- One account is for one streamer. Do not share, sell or transfer your account or your subscription.
- You must be at least 18 years old to buy a subscription.
4. One streaming room
Each subscription runs one race room at a time, from one PC at a time. You can move the room to another PC by taking it over there; the first PC then stops running it.
5. Subscription and renewal
- SimonLive is one subscription, billed monthly or yearly. Prices are on the Pricing page. The final amount, including any tax, is shown at checkout before you pay.
- Your subscription renews automatically at the end of each billing period until you cancel.
- If we change the price, we will tell you before it applies. The new price applies from your next renewal after that notice, and you can cancel before then.
- There is no free trial.
6. Payment
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle takes your payment, charges any tax and handles billing questions, receipts and refunds. Paddle’s Buyer Terms also apply to your purchase.
Your card details go to Paddle. SimonLive never receives or stores them.
7. Cancellation and expiry
- You can cancel at any time in the SimonLive app (Manage subscription) or through Paddle. Cancelling stops the next renewal. Your access continues until the end of the period you have paid for, then ends.
- If a renewal payment fails, Paddle may try again. Your access continues for a short grace period (currently 3 days), then stops until the payment succeeds.
- When access ends, SimonLive stops starting new races. If it ends by itself during a LIVE, the race already running may finish (at most 4 hours).
8. Refunds
Refunds are handled by Paddle under Paddle’s Refund Policy and the consumer law that applies to you. SimonLive has no money-back guarantee of its own and gives no discretionary refunds for a change of mind. See our Refund Policy.
9. Permitted use
Use SimonLive for your own TikTok LIVE streams, in line with these Terms and with TikTok’s and Roblox’s own rules. Do not:
- copy, resell, share or sublicense SimonLive;
- reverse engineer, modify or bypass its protections or account checks;
- attack, overload or abuse the SimonLive service;
- use SimonLive for gambling, betting or paid prize draws;
- use SimonLive in a way that breaks the law or harms others.
10. TikTok and Roblox
SimonLive works with TikTok LIVE and Roblox, which are run by third parties. We do not control them. Their changes, outages, rules or decisions about your accounts can limit or stop SimonLive features. We work to keep SimonLive compatible but cannot guarantee it. You are responsible for following TikTok’s and Roblox’s terms in your streams.
11. Abuse and suspension
We may suspend or end your access if you seriously or repeatedly break these Terms, commit fraud or payment abuse, or put SimonLive, other users or viewers at risk. Any refund in that case follows Paddle’s Refund Policy and the law.
12. Chargebacks
If something is wrong with a payment, contact us or Paddle first. Access may be suspended while a chargeback is reviewed, and ended after an unjustified one.
13. Support
- Support is by email: simondcshop@gmail.com. Include your SimonLive account email and, for payments, your Paddle order number.
- Be respectful. We may decline requests that are abusive or contain false information.
- Never send us passwords, sign-in codes or card numbers.
14. Availability and liability
We work to keep SimonLive available and working, but we do not promise that it will be uninterrupted or free of errors. To the extent the law allows, SimonLive is provided “as is”.
To the extent the law allows, we are not liable for indirect or consequential loss, or for lost earnings from your streams, and our total liability is limited to what you paid for SimonLive in the 12 months before the claim. Nothing in these Terms limits liability or rights that the law does not allow to be limited.
15. Changes to SimonLive
We may change, add or remove features. If we stop offering SimonLive, we will tell you in advance and stop future renewals.
16. Changes to these Terms
We may update these Terms. We will publish the new version here with a new date and tell you about important changes in the app or by email. If you keep using SimonLive after that, the new Terms apply. If you do not agree, cancel your subscription.
17. Governing law
These Terms are governed by the laws of Thailand. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live. These Terms are in English and Thai; if the two differ, the English version applies unless the law requires otherwise.
